dude it's a fish. its not a 7yr old girl running through a field trying to catch a butterfly, then getting tackled and set on fire by a group of rednecks.
1) the fish is dead - just because its moving, doesn't mean its alive.
2) being "tortured" assumes it experiences pain in the same way we do... which is also not true
3) it has zero concept of whats happening, doesn't experience terror or anything else. you are simply projecting your own human emotions/experience onto what is little more than a house plant with eyes.
