      He's got until Monday, Dec 18 to produce the requested document.       You think they are going to hand over id''s for their girls to an affiliate, just so he can prove to a domain registrar that the girls are legal? Especially when the domain registrar has no legal right to even ask for these items. Think about that one for a second.

      On top of that, the entire 2257 bill has a court ordered injunction on it in terms for secondary producers. So in theory the govt doesn't even have the right to inspect a secondary producers records at this point. Yet you think a domain registrar should be able to?

      I can say this, as someone whom has a few teen sites with their domains registered at DirectNic.. I'm seriously wondering why I haven't transfered them away with the lack of response to this serious matter from them.

      I'm going to give them until Fri to come up with an appropriate response to this serious issue, or I'm transferring my names elsewhere.

                well i'm a MikeAI guy, my closest ally in this biz and i know that this policy is in place for a good reason from Directnic's side - they and all of us in this business are all swimming in murky waters because of the US political enviroment. none of you armchair lawyers know shit one way or the other, you are talking out of your asses, which of course is what makes adult webmaster boards what they are! Mike included!

                that TGP site sure looks bad, even though I'm pretty sure that the girls in question who look underage are 18 plus - show that page to 100 NON-INDUSTRY average citizens, to anybody who doesn't have alot of knowledge of the industry and the teen niche in particular an assumption of child porn is reasonable.

                            I disagree in both of those points. Sometimes it's smarter not to attract too much unwanted attention, it's not like the industry gets much love from politicians and legal authorities and I see no point in giving them even more reasons to hate us. I'd rather protect my business and accept that some ways of making money may be legal but not very smart long term.

                            Yes, it's legal if they are 18, but if they look underage, you probably know what kind of surfers you are dealing with...I wouldn't want to make money with them, because I hate them for what they are really looking for and I don't want to feed their sick fantasies !

                                  Regarding the Xbiz statement... a lawyer saying what is legal and what is illegal means nothing, honestly. It is his *opinion* on the matter. A well-read opinion to be sure, but nothing is concrete until a judge makes a decision on the matter. As far as I know there's no legal precedent here (other than simple contract law), so we're in uncharted territory until a judge somewhere decides the first case. (The issue being whether or not a registrar is liable for content appearing on domains that it leases out, and therefore needs to be proactive in protecting itself and policing said domains for illegal content.)

                                  What it really comes down to is that DirecNic is providing a service with a clear TOS available to read over before you agree to their contract. They could state in their TOS that they can suspend service to you if they find out your house is blue, and if you sign that contract, you're agreeing to this. By signing the contract, you are giving them the right to suspend service even if there is no law stating that people with blue houses can't use this certain type of service. There doesn't have to be a law in existence; you agreed to this and signed a contract.

                                  The one way I do see this benefitting everyone is that it should make them realize just how precariously they're sitting with regards to 2257 documentation. This could have just as easily been the FBI showing up at Slick's door. If the FBI showed up at YOUR door tomorrow, would you be ready? Could you easily hand them all the documentation of all the models appearing on your websites?

                                    And it's funny you mentioned houses - look at HOAs. They can have contracts that tell you what color your house can be. And if you paint it a different color, they can fine you and put a lien on your house. Now, does the law say you can't paint your house a specific color? No, but the law says the contract can be enforced.

                                    It seems a lot of people think it would have been better for DirectNic to just have sent the authorities over to Slick's office for a 2257 check instead of contacting him first. And since he's already admitted he doesn't have these documents, then he might not be able to have access to a computer from which to post his complaints.

                                        - It is better to keep your own backyard clean rather than having the government(s) clean it by force... they tend to use bombs not brooms.
                                        - The look is important only because it provides context. Public perception is important, because the public is the one that complains.

Why is it such a huge deal and fall under "violation of privacy" for a sponsor or content producer to allow an affiliate to show directnic that same proof of age?

                                                        As for your "bouncer" deal, please remember this: When the girl signed the original model release and provided the ID, it became a document of proof of age for those images. The model release and agreement define what can and cannot be done, and 2257 sets certain standards that need to be respected by the primary producer.

                                                        Directnic indicated no intention to retain the documents, nor did they ask for any personal information, name, or address for the model, just a photo ID with the image and date of birth visible. I defy you to find anywhere that Dirctnic says "we are going to keep this on file". They did not. Please re-read the text you just quoted.

                                                                    Obviously that's one I got for a trademark issue, and if CP's in question, just tell the guy to move his shit off your service after taking screenshots and reporting him.

                                                                                      Next thing we're gonna see is some merchant account provider or cc processor demanding the 2257 proof on all the models on your site as well or they will shut off your merchant account / Processor account....because, well they are processing payments for your site and therefore are secondary producers.... which is very far from the definition of secondary producer, not to mention that even inspection of secondary producer documents is stayed right now by court order.

                                                                                      The laws created are meant to be policed by government agencies and their legal assigns or "agents". So far, no one has appointed any domain registrars as federal inspection agents.

                                                                                      If DirectNIC has a problem with the "look" of models, yes, they could have asked for an affidavit from the site owner stating all models were of age at the time of photography.... or they could have passed their suspicion along to a proper government agency that is charged with policing these laws...not make themselves out to be the policing authority. Maybe they thought they would intervene and review the docs first before reporting it, but the system is not setup this way for a reason. They should have done what they thought was the right thing and reported the site, and then the proper authorities could review the documents...

                                                                                      So if it is illegal for the Feds to do inspections of secondary docs at this time because of the court order, isn't it a bit far fetched for a domain registrar to APPOINT themselves as a 2257 review agent and also inspect records as a secondary producer when that part of the law is enjoined at this time?

                                                                                        Actually Directnic is forcing the owner of the domain to stay in business with them as they've locked his domain. Directnic is a registrar, not a host, not the FBI. If they want to assist in an investigation all they have to do is give all info they have to authorities. Even if there is CP on the domain, locking someones domain so they can't change registrars has no real effect long term, and quite frankly, is stupid

                                                                                              I don't think that Mr Douglas made his comments with the full understanding of the situation of the circumstances that Directnic was facing, and I don't think that Mr Douglas spent too much time looking at Slick's sites... otherwise his comments might have been a little bit more reserved.

If DirectNIC have any complaint concerning illegality - stop fucking around and behaving like asses and report this to law enforcement. If valid, a court will make any judgements and tell DirectNIC what to do with a domain.

It's also obvious DN have opened themselves up to having their TOS examined and also to other possible liabilty.
