You asking me personally? If the offense is within the US, I lift a phone and speak with an officer of the US govt who has an interest in this area. If it falls outside US jurisdiction - it's reported to a "clearing house" - iwf.org.uk - who have "hotlines" to law enforcement in many countries.
Don't, for one moment even assume that all I care about is "keeping the adult biz clean". Child abuse is not about covering the ass of the adult business - it's about violations against children. These offenses are more relevant than any imaging - these images are a product "after the horse had bolted".
I'll repeat - it is not the responsibility of any other party than law enforcement to engage in monitoring websites for potential material - that is the job of law enforcement to enforce the law. (And it can also not be helpful for idiots messing in the middle of their enquiries - including DirectNic).

Prob the principle is fine in theory and the purported reasons for it may be admirable, but, in reality, it's getting domain registrars to do the job of law enforcement - and chances are, screw that up in the process. A domain registrar may not be the best choice as to who makes decisions which are best suited to lawyers and law enforcement - that can be extended to make decisions on any subject that may arise.
There are also other issues - more ICANN related which cover jurisdictional issues which have little to do with the ICANN subcontractor - ie DN.
Would be interesting to see if any other registrars within the US elect a similar change of TOS. In that instance, odds on are that pressure is being put on them from elsewhere - pressure which would not look good if put on ICANN.XXX TLD's - Another mosquito to swat.Comment

If the copyright holder of the photo lodged a DMCA complaint against Alex for using the photo, his host/billing company/service provider would then give him notice that there was a complaint and that he would need to respond with written proof that he was using the photo legally.I'm not attacking you personally. In any case, refusing to either produce the correct documentation or lodge a counter complaint within the period of time allotted under DMCA would cause either his hosting, his billing or potentially his domain name rights to be suspended or even terminated.

No one's asking for anything but a picture with a birthdate on it -- no name, no address, no SSN, just a picture and a birthdate. That's correct, but neither does DirectNIC own them. After i paid the year fee at least i have SOME rights on the domain, now tell me please what kind of rights DirectNic as it's not the owner.
Readed the whole agreement btw icann and the registars and i was NOT able to find a point that allows the registar to terminate, delete, suspend, shutdown or lock and accunt other than after a domain dispute descission
but maybe i miss again something in this agreement

Pay $15, agree to and forllow the terms, and you gain the rights to use a domain name for a year. Failure to follow the terms nullifies the agreement, and things revert to how they were before the contact was engaged (or other clauses invoked covering the failure to comply).
It's not hard. Twisting it around in circles doesn't change the underlying, simple, well founded basis on which the contract is drawn.

In an email sent by Intercosmos, directNIC?s parent company, and obtained by XBIZ, law clerk Juli Silver Green requested that SlicksNetwork.com submit all state issued photo IDs that clearly show the face and date of birth of the models.
Green threatened the site with closure if the site?s publisher doesn?t comply by Dec. 18. DirectNIC imposed a lock on the domains it alleges have questionable content, preventing the owner from transferring them to another registrar.
SlicksNetwork.com?s owner Slick said that directNIC does not host his sites, it just serves as the registrar. SlicksNetwork.com contains 14 TGP sites that link to sponsor programs.
First Amendment attorney and Free Speech Coalition Chairman Jeffrey Douglas said the ID request is unprecedented, and more importantly, a violation of privacy laws. According to Douglas, the request is illegal, and also could have a chilling effect on the free speech of webmasters that deal in legal teen content.
?This is a blatant and absolute violation of privacy laws,? Douglas told XBIZ. ?There?s absolutely no legal liability for the registrar if underage models appear on a website. DirectNIC is an officious intermeddler.?
Upon receiving a complaint of child pornography, there are legal courses of action for directNIC to take, Douglas said. Since it has no legal right to obtain personally identifiable information from the website?s models, the company should have alerted the proper legal authorities, but instead it decided to take the law into its own hands.
The FBI, the Association of Sites Advocating Child Protection (ASACP) and the National Center for Missing and Exploited Children operate hotlines for the reporting of child pornography.
?The bottom line is that if [directNIC] received a complaint about child porn, there are a numerous avenues for them to report it to the proper legal authorities,? Douglas said. ?DirectNIC has no remote prayer to legally justify their request. They are licensed to provide a service ? not to police content. I would think that upon hearing this, most adult companies would transfer their domains [away from directNIC] immediately.?

FYI, Canada's privacy laws are pretty strick. Sending the photo with birthdate would deffinatly violate privacy laws.

Some comments:
1) The way this was spun to make it an entirely different issue borders on masterful. I predict everyone will have a short memory on this one, unless there's significant traction from BoyAlley's boycott. You have to give Mike some props on the way this post has shifted the very fabric of the debate.
2) Directnic owes RawAlex some free domains at the very LEAST, and it'd be lame if he wasn't compensated for his work in this thread and others. It looks like a full time job, in volume, intellectual capital, and sheer dedication. You have to admire it, whatever the reason.
3) CP disgusts me, as it disgusts most of you, and not keeping records is an ignorant way to do business nowadays. However, it's more than a little scary that a REGISTRAR is circumventing an infrastructure already in place to handle this sort of thing.
4) You may not like the kind of site being run, but you all know about the "slippery slope." Who gets their domains locked next, and for what reason? At least with the courts, there's an established process to proving your guilt or innocence.
5) I'd like to see how this plays out before transferring any domains in a panic. I'm going to sit back and give Directnic a chance to shed some further illumination into some of the dark corners of this event. They've already very clearly said that anyone with an issue should take their business elsewhere, and you have to respect a company that can say "oh well, fuck you," and not have to look back. There's clearly a reason they've got enough money that they don't give a shit about your business, and you don't accumulate those kind of resources by delivering inferior quality and products. It's worth hearing them out further, in my opinion.
6) This is a drive-by, sorry, I will be highly unlikely to comment on any responses to this. I think it's important to HAVE an opinion on this one way or the other, but at this point, everyone is at everyone else's throats. Remember: "Opinions are like assholes. That's plenty of time to find it, or at least figure out whose content it is -- via sponsor or submitter, someone's going to get paid down the line if there's a sale so it's not like this is impossible. I guarantee that would be majorly in violation of the Personal Information Protection Act, and that could end people up in jail (at least on this end) for a very long time. In fact, in order to even COLLECT content and have it on file in Canada, you have to have a special privacy release from the model. It's yet ANOTHER release to allow that information to be shared with OTHER parties, and the liabilties and accountability involved are major. The penalties can be decades in jail. We put together a legal seminar on Cross-Border Data Flow where the Personal Information Protection Act is concerned, and it's beyond ugly. I know Europe has similar privacy laws that are even more strict than we have here. I guess any Canadians on Directnic should move, because unless you have taken all the proper legal precautions with releases, you will be between a rock and a hard place if they request ID's (which I don't believe they legally can regardless, I'd like to hear an actual LAWYER comment on this though).Comment

One would hope it would simply be turned over to the proper authorities. If someone WAS running a CP operations on those domains, they certainly know it's time to jump ship and move on now, don't they? The cause is noble, and I understand there may be some minor degree of liability involved, but the truth is it seems the gun was jumped a bit perhaps?Some comments:
3) CP disgusts me, as it disgusts most of you, and not keeping records is an ignorant way to do business nowadays. However, it's more than a little scary that a REGISTRAR is circumventing an infrastructure already in place to handle this sort of thing.
4) You may not like the kind of site being run, but you all know about the "slippery slope." Who gets their domains locked next, and for what reason? At least with the courts, there's an established process to proving your guilt or innocence.Comment
