    Is it "porn" if...

Is it considered "porn" if it is in a zip file?

Let's say I want to send a CD of images purchased online to someone in a no-ship zip code.

I zip the images up and burn to CD, at which point these images become an unviewable format as they are.

I think technically, this is no longer considered a media format, as well, it requires an action from the end-user to be able to view the contents. This action requires software that I would not be providing.

What do you think about this?

I would say it is still porn. I don't think it what format it is, but what it actually is.

If you mailed someone a box full of porn DVDs, but put them in a lox box that had a combination and only the end user had the password, it is still a box of porn DVDs.

I'm not lawyer though, but I would never bet my potential freedom on a technicality.

Zipped up adult content becomes a different format, and in it's zipped form, becomes unviewable / unusable without action from the end-user to change it's format. DVDs are still DVDs, whether they are in a lock box or not. I know I'm splitting hairs, but it's been on my mind lately, and just curious what others have to say.

We we both have WINZIP installed on our systems.. then it's not unviewable. Actually WIndows Explorer has the UNZIP capability built right in.. so you wouldn't need anything extra to view the files.

Now encrypting the files.. that's a whole other story.

If I send encrypted state secrets to China, and since they are just random letters and jumbled code until they are decoded using a special one of a kind program that would prevent anyone but the intended buyer from ever seeing the secrets, is it still espionage?

Use a rar at least, zip is included in vista, nowadays some users don't even know it's different from a normal folder

but yeah that just doesn't sound like it will work too well if push comes to shove

You can PW protect either one. Plus zip has always came with windows for the most part. Then lets not get to silly, windows knows what a RAR is and if you do not have it (many zip programs will open it) it will ask you if you want it to find the right program for it.

Plus he would not be concerned with just anyone opening it up. His concern would be the postal inspector or other legal entity.

If I put a cake in a box, is it still a cake? You can't eat it without opening the box.
Yes, it's still a cake. It's a cake in a fucking box. Porn in a zip file is porn - in a zip file.

This question actually covers a huge class of "legal" questions and arguments made
by people who have no idea how the legal system works. What many people don't
realize is that judges and juries possess a brain. 99% of the time, that brain has some
common sense. Trying to get tricky with semantics will normally only get you a heavier
sentence because you're annoying. Most judges know what the law basically says -
they don't care about the exact wording. You see these ridiculous claims by people like
the dorks trying to tell you that you don't have to pay income tax because one part of
the law says uses the word "person" and another part uses some other word. So what,
the law is perfectly clear to anyone with any common sense - the law says that you
                              have to pay your taxes.

Let's look at it another way. Let's say you posted saying I stole your money.
I deny it. There's drama, then finally I say "I didn't steal your money, I stole your
wallet, which had money your money in it.". I still stole your money, right? Anybody
with more than two brain cells knows that if I steal your wallet, and your money
is in your wallet, I stole your money. Same thing with porn - if you send porn in
a box, porn in a bag, porn in a zip file, or porn in a rar file, you're sending porn.
