there is no restraining order in canada.

I had a guy make several death threats to me - called the police on him and he admitted making death threats to me to a police officer - there is a police incident report documenting this.

we have two things here - a protection order and a peace bond. the protection oder is much stronger.

so I set a hearing with a judge for a protection order.
(why do i want this? wasn't scared but if the fucker came for me and I had to kill him in self defense no jury in the world would convict me with a protection order - and i wouldnt' even be arrested i'd be released immediatly so long as it was clear he came for me and I killed him - without that it can be looked at as a fight with equal responsibility - it also allows me to take leathal force in response if he comes near me as I then have legitimate reason to fear for my life and he's not legally allowed to come near me)

so anyway - first time the judge said I needed witnesses PLUS the police report? WTF - so i rescheduled and went back with 3 witnesses. This time the judge said it looks warrented but he has a history of showing up for court so he wouldnt' issue as the judge felt he had the right to defend his side so told me i had ot get a peace bond. That takes a month - so i asked the judge what do i do for a month - he just shrugged his shoulders.

So i register for the peace bond - it HAS to be served by the courts sherifs - anyway the guy moved and changed his phone number so I had no way of contacting him. He was still hurrassing me though. The sherif tried a few times to reach him - and wasn't able to find him. This is where it gets fucked up - in the mean time i had a small claims case against him (which i won) and I told the sherif's office he would be at court that day - EASY to server - they wouldn't do that.!!!!!!!!!!! - anyway i went back down the filing office to ask what i can do to serve this guy - and she told me and I quote "well if they can't find him that's a good thing as he's gone" - I screamed in the office at her - security came by but let me rant as they even thought it was bullshit. He can find me but the courts won't issue a protection order when there's a police record of death threats cause he has a history of showing up for court but the sheriff can't find him so they can't serve him so I can't get a court case and I can't serve him on my own with a private service for a protection order, yet he can and still does continue to threaten me.

anyway I documented the times i applied for a protection order and peace bond so if something ever does happen any jury will know I tried everything to get these in place.


so yeah - canada doesn't have restraining orders anymore - we have protection orders and peace bonds but unless you're a female you're pretty much not going to get them

So if he's not even 16, chances are he's living at home. Shouldn't the arrest records, police reports, anything - have his address on them? Get a copy of the police report.

If it was due to traffic accident (sounded like it due to the GTA reference) then go to his state / county's public records website. Most of them list traffic tickets / court docs etc - it's all public record. If that's not enough, take his last name/address, go to the Property Appraiser's site for the county and look it up - it will have their names there. Also try marriage records etc.


I wouldn't be opposed to sending a picture of your dad from time to time... but first you might want to try opening a civil case for damages and hit them where it hurts.

you never get fuck all in canada on those and they cost more in legal fees than you can get best case scenario.
