for some reason he believes that publically available and accessable torrents of full porn siterips and full porn DVD rips (and of course software, hollywood, etc) are perfectly acceptable - and are really just an innocent 'backup'.
the rs-dvr case just established the difference between a public transmission and a public performance.

i have repeatedly said that setting up a private tracker protects your content just as well as going streaming only. IT actually allows you to raise your price and get more sales, while being honest. Unlike streaming only where you have to lie to your customers/punish review sites if they expose your DRM.

the point is to shift the legal arguement to eliminate the DCMA "abuse" without taking away the fair use rights that safe harbor is designed to protect.
