Legal retainer or a party?

I speak to a ton of program and site owners and webmasters on a daily basis and it never ceases to amaze me how many people don't have adequate adult legal protection in this biz. I equate it to having unprotected sex on a regular basis... you aren't guaranteed to get a disease, but the risk factor certainly isn't being minimized LOL...

I often hear "I don't need a lawyer, I'm not being sued" or "I use my brother in law for free... he's a business attorney" or "I can't afford it right now" or something along those lines. And then often times I'll see these same people spend double on a party of what their retainer fee would have cost.

Should I not be amazed that the "it won't happen to me" mentality is still going strong in this day and age?

It's always going to be going on. Lawyers cost money. A lot of webmasters feel they don't need to spend the money on it. Luckily for me, I have mine on retainer and ready for the lawsuits to come. LOL

It's definately better to be safe than sorry and have a lawyer on retainer than not to have one!

Exactly. God forbid you get sued and don't have a lawyer... you don't think they won't smell the desperation and jack up their retainer fees at that time? Too many people in this biz don't realize that or think long term...

It's true, you have to think long term. I have a lot of lawyers in the fam and can attest that they will smell the desperation and jack the retainer up. Still love 'em though. LOL

Jay, the simple fact of the adult online business is people are in it for a party, they want to be "pimpin' " and they don't have a clue what can come down on them so quickly.

I fall in the "screw the party, just quit shaving me and pay a decent amount for a signup" group these days. Skip the party, turn the shave down by 20%, and watch your business grow and flourish.

Well of course I shamelessly recommend our attorney Eric Bernstein first and foremost (see sig... or email me at jay at ynot dot com for more info.) but I also think Walters, Douglas, Apgood and Piccionelli are a few other great choices.

Hey Alex, I'll be the first to admit I moved from the mainstream to adult nearly 7 years ago partially for the "party". But then again... the "7 years" part is testament to my interest in the long term part of this biz taking priority. You must be at about 10 years + now?

Jay, yeah, 10 years and counting... but honestly, with all the screwjobs, scamming, and outright lying going on in this business, I am not as confident I want to stay around for 10 more. Things have turned really very mean and ugly in the last 12 months.

This is the first year where I have seen more lawsuits than successful new programs, more sponsors involved in rather scummy deals (like buying traffic from scumware companies), and more people than ever resorting to selling toolbar installs and other less than honest tricks to get things done.

Those are the people that need the lawyers...

You feel it too huh? I would totally agree that the last 12 months have been ugly. A lot of desperation out there for sure. And ironically enough... those very people you mention are ones that I would try to shy Bernstein away from...

Yup. It's ugly, getting uglier, and some of the very biggest companies in "our industry" have gotten into bed with some of the ugliest toolbar and spyware companies. They honestly don't appear to give a flying fuck about it, either, not being shy about talking about it in public.

Sad, really.

Yea sad but true attorneys are a way of life. Dang those guys make some serious cash too. What really irritates me is that it doesnt matter how right you are only who has the best attorney. So if you dont have a good one you might as well just give your shit away for free.

Well put. Sometimes it's said that when a lawsuit is concerned, the true winners every time are the attorneys. When a lawsuit isn't concerned, if you are protected, then you are always the winner.

However... you also make a good point about having the best attorney. In a biz as high risk high reward as the one we are all in here... it makes sense to me to always be well equipped (pun intended). With people going after your livelihood from outside AND inside the industry... it baffles me where a lot of people's priorities lie when it comes to adult legal protection vs. acting like a "pimp". And I'm not seeing too many of them speaking up in this thread.
