And when it comes to the internet there should be no community standard. I can understand the community standard if it is sold at a store in a community because then that store is part of said community. But if the product is ordered online and shipped to you the only people who know you have it is you, the person who sold it to you and anyone you decide to tell. There is no community involvement.
It is no different than letting the community decide that books you can order from Amazon or what music you can download from itunes.Comment

"Allthough I do not personally support certain niches"
But they don't deserve doing hard time like bankrobbers, rapist, child molesters, madoff's & subprime loan inventors...
Their niche is is bit out of the ordinary but still I would rather deal with Rob Black then with Mr. Madoff or put my money in Lehman's. But I guess Lehman guys will not share a cell with Rob (hey, maybe their lies the answer.. where $talks&bs_walks)Comment

Thats what I ask myself all the time. Americans love violence so murder and torture is fine. Just no fucking. Go rent some Rated R horror flicks. Who is going to say those aren't obscene?I don't understand this. At all.
I recently purchased one of the new James Bond movies on DVD from Amazon.com. Rape is illegal, but so is murder. How come no one got arrested when I purchased a DVD that displays graphic violence, people being murdered, and Daniel Craig having his balls tickled when he's buck ass naked by the bad guy who is whipping his nut sack? \
What's the fucking difference? When Hollywood does it it's considered art, but when we do it it's considered illegal?Comment

It's total bullshit. The U.S. govt. is becoming so repressive of people.
Having said that...Rob Black has done some crazy ass shit to get the govt. to target him. First he owned the pro wrestling promotion "Ring Of Honor" and then left that in disgrace after being caught up in some scandal with an underage boy. That kind of stuff just puts you all over the government radar. And with our govt., that's a bad thing. The founding fathers are rolling in their graves right now.-Robbie

That wasn't Rob Black that owned Ring of Honor, that was a guy named Rob Feinstein that also owned a company called RF Video that sold pro wrestling and MMA videos. Feinstein got caught talking to an underage boy online that was actually an undercover cop. Rob Black owned a wrestling company called XPW that operated from 1999-2003 and was doing ok for itself until the whole Pittsburgh legal issues, and Rob suspended operations of XPW to concentrate on his defense...It's total bullshit. The U.S. govt. is becoming so repressive of people.

While I don't like what they were shooting, and the same goes for Max Hardcore, I don't think nobody should go to jail over it. Yes, they pushed the limits and yes they may have even been asking for unwanted attention, but jail time? Come on, that's bull shit. One more reason I'm glad I don't live in the USA any more.
So the question is, with Rob AND Max in jail, who's next?Comment

For something to be "obscene" it must be shown that the average person, applying contemporary community standards and viewing the material as a whole, would find (1) that the work appeals predominantly to "prurient" interest; (2) that it depicts or describes sexual conduct in a patently offensive way; and (3) that it lacks serious literary, artistic, political or scientific value.
http://www.definition-of.com/prurient+interest
prurient interest :
(Adult / Slang)
A legal term defined, in 1984, by the U.S. Court of Appeals for the Ninth Circuit as ' a shameful and morbid interest in nudity, sex, or excretion.'
Basically if the rape/murder/torture itself is the only plot you have then don't expect to
win under this statue.

If you want to lose
then put gore
in your hardcore
and drink a lot of booze.
