    what kind of uneducated person buys TLDs that are trademarked?

    I don't get it. Only in the adult biz do people think they can get away with this sort of thing. Just saw a few examples. You can tell that the understanding of trademark law in this biz is miniscule if even existent. Been reading some other threads on a few other boards this past week and its been makin me think.

    Makes you wonder how intelligent some people are. If I was going to buy domains for things I would certainly check to see if they were trademarked first.

    i actually dont think its a bad idea. you figure by the time a company that owns the trademark to the domain is able to have its lawyers contact you, you have already made a decent amount of advertising dollars off of the domain.

    its a quick dollar for someone.

      you mean more than the day it takes someone in adult to find out something? or you just looking for your sig spot position?

      actually what you've just said makes no sense when speaking of the adult space. trademark owners know almost immediately.

        Not all trademark owners police thier marks well, some dont find out for weeks, months or even years down the road, and others choose not to do anything about it until the offending site gets very popular or causes a problem.

        I once had a domain of a major telephone company (an RBOC) and the domain was "CompanyNameCable.com", when all of the RBOCs were playing around with the idea of this new thing called DSL (a friend of mine registered "CompanyNameDSL.com" and started his own site) and also IPTV and they were thinking of getting into the cable business as well. I used the domain to bash the company. That telephone company didnt bother to do anything (other than send legal threats, which were ignored in the order recived) and they didnt sue me and my friend until I was ranking #1 on Google and they were #2 for "Company Cable".

          I assume you mean second-level domains. Using gofuckyouself.com as an example, the TLD is ".com" and and the SLD is "gofuckyourself".

            Well, it works out like this... If I am pushing the owners website(s) and I am doing more than just SE marketing for those websites (building their brand for them (especially on new sites)) then they don't give a flying fuck because they are making money that they would not have made on their own...

            Think about it.. Would they have made it on their own? Fuck no! And unlike mainstream they realize it is better to let me keep it. I will drive 100,000 hits into their program in the same time they would have done 300 total because they don't have time to devolope said domain....

            So before you rock the boat, take a lesson in economics, communication and marketing 101.

                and btw if I'm not mistaken you can be sued for registering the domain even if you don't own it anymore, but if I lived in Somalia I wouldn't have anything to worry about, they have no government there, let alone any laws

                    Its a good idea to see if the domain you get for you company has a trade mark on it. Its never a too great idea to invest in some thing that can be taken from you.

                        no idea what the forum was - it was probably 1-2 years ago, but it was a domain forum and some dude sold domains with car names like buyford.com, bmwcars.com etc (made up the examples, don't remember the actual names either), sorry couldn't be more of a help

                                        no you are wrong on that. very few "traditionalist" companies police their online domains. one can make some serious cash off of these domains. one of the things i use to do back in the day was squat domains. i have experienced this alot. very few companies care if you have a domain of a trademarked item (especially awhile ago back in the late 1990's). this allowed people to make small fortunes. and minusonebit does back me up with this statement.

                                        does it really make no sense? try going back and taking some old time pornstars names or porn directors or producers or others maybe even old time porn movies. what you will find is alot of the domains can be purchased and money can be made without anyone filing any type of C&D orders against you.

                                        in reality you can make a good amount of money off of domains before any type of legal action can be taken against you. we all know how the legal system works in the USA and how long certain C&D orders can take to be served. in that time your profiting. and there is no punishment if you hand over the domain after receiving a C&D order, so you just made a profit.

                                                  Hmm that is true but sometime you cant check is something trademarked or not.For example on caffe bar took name carpe diem but they need to remove it beacuse some hotel chain has been using that name.But i dont think they could know that.Plus,if you have registred domain before someone trademarket that term,you still have right for it.
