Not enough information to form an opinion on this one. Lots of men don't realize how intimidating they can be when a woman is already emotional about something. It sounds like things escalated way too fast for both parties, but whether or not it's a dealbreaker is up to them, of course.

Hello???? Anybody home in there???? If he came into contact with her AT ALL during a confrontation it is battery. Actually, it doesn't have to even be during a confrontation. All it has to be is "unwanted contact". Call a fucking lawyer and ask them genius.

This is how California defines battery:
A battery is any willful and unlawful use of force or violence upon the person of another.

He willfully used force to take something from her. Maybe it is you who should stop proving your ignorance.

I had no choice but to take her phone, I was calm, she was not. I was just trying to save her from embarrasing me and herself because she always overreacts and regrets the stupid stuff she does the next day.
