There are some "patently obscene" things, like child pornography, but most of the rest of it is gray area which depends upon a judge or a jury to finally settle it.

and what's makes that area more gray is that there are almost no national standards on what is/isn't obscene (save for child porn). The Supreme Court gave localities the right to define obscenity for *their* communities. Obscenity is a local issue, which is a lot of porn is illegal in a few american states and/or counties. Likewise, that's why prostitution is legal in parts of Nevada but not elsewhere.
