I believe he has already said he wasn't going to pursue it and instead look towards the future and change current policy rather than spending the time persecuting/prosecuting the last administration.
Aside from that, I also believe Bush and repubs had legislation passed 2 or 3 years ago that would indemnify them of any wrongdoing or legal proceedings for their conduct.
