Let me clear up some confusion. The FTC settlement prohibits affiliates from promoting us using both an unsolicited, sexually explicit ad.
In order to be in violation of this order, an affiliate would have to do two things at once:
1. They would have to create a sexually explicit ad for one of our sites. Non-sexually-explicit ads that
appear on pages with sexually explicit content do not qualify as sexually explicit ads.
2. They would then have to display that ad in an unsolicited manner. Practically speaking, this would occur
either via a popup that originated on a non-sexually-explicit site, or via a link to the sexually explicit ad where
the user would have no expectation that sexually explicit content lay on the other side.
It is important to note that if you only promote us using our own landing pages and banners you are inherently compliant since we have ensured that all promo material is non-sexually explicit. You can also create your own ads or landing pages and be 100% certain that they comply if the are non-sexually explicit.
As I mentioned above a compliant ad on a sexually explicit site (say a hardcore TGP) is not a violation of the agreement and therefore our TOU.
A hardcore TGP with explicit ads for AFF/Cams is also not in violation if the user doesn't arrive on the site in an unsolicited manner. For instance a pop to the TGP with explicit ads for AFF that manifests while checking stock prices would be unsolicited. TGPs that have over 18-confirmation bridge pages and/or receive traffic only from other adult sites do not meet the unsolicited requirement and therefore can have explicit ads.
