I asked "How scared do you have to be?",
"When are you in real trouble when you show pictures of celebs?", "When are you at a point they close you down?" and "Do simple galleries get you in trouble also?"

None of these questions entailed the question if it was legal or not.

You get in trouble(serious trouble) when:

You use content of celebs not licensed to you
(APIC or Webposse will have a field day)

I know ex celeb webmasters still paying the fines for sites they ran 4 years back.

When you use names of Celebrities on your site that are copyrighted or even trademarked.

Good examples Alicia Milano and Britney Spears(I think they will allow this for educational means )

so only thing sponsors must do is just sue them in Turkey

High Society Magazine and Celebrity Sleuth have been
publishing celebrity photos for about 20 years and
usually with no license. Even Playboy runs a sexiest
celebrity feature twice per year with no license to
the photos.

Its all about how you display the site. If its a site
called "celebritywhores" and its full of fakes on the
homepage .. well, your gonna get fucked.

Most celeb pics on the net have come from places like Hello Magazine etc, the owner has been paid and the publication got its rewards. I have a few celeb pages still kicking around and never had anyone complain.
If someone did complain then I would just remove the pics without question. Celebs feed off free publicity so its all a matter of using some common sense and making sure there is a contact address on each site.

Why are the processors not worried by celeb sites

ccbill for sites like the xxxpaycheck ones
ibill for that babylonx site

Celebs are public property, its the price they pay for fame and fortune. Promoters and sponsors know all about getting a free lunch.

There are plenty of "illegal" things that various webmasters do - some without even knowing it.

Celebrity sites may or may not be one of them.

Unless you run a cild porn site or rack up charges on peoples credit cards - you will almost certainly get a cease and desist letter before any legal action is taken.

If anyone can point to a single legal case where this isn't the case (someone was awarded damges without an order for cease and desist) - I would love to see it.

You want to make sure you have legitimate contact information. If you are really worried - set up a link and follow the terms of the DCMA - APIC and everyone else can do whatever they want - they aren't going to be able to do shit.

I don't believe there is any legal precedent on fake celebrity photos (I checked all cases at the federal appeals level and could find none). I would think you would be much more likely to get in trouble for REAL celebrity photos - as these are clearly copyrighted - and any arguments of derivitive works would be hard to make.

Is it illegal? I don't know. There are tons of sponsores out there with these sites. They would go after them before you. They will send you a letter/email if they want to complain.

Even if you look at cases of what appears to be blatent copyright infringement - they are usually warned first - and even if they go to court - it is usually to get an injunction. These cases are some of the most expensive to pursue. They are not going to spend the time, effort, and money if you are willing to take down the photos they don't like.

If they really have a case - they will go after the dozen or so popular sites that are all over the net making money month after month. What good is it to go after you when there are not going after the source of the "problem". It would be like going after individual napster users while leaving napster alone.

How scared do you have to be? As long as these sites are up - I wouldn't worry.

I won't worry about the few pics we have and use... we even have a note that says we will remove the pics right away after an email. Never heard a thing in a year or so.
