    obama embraces creative common

    Yet, that a Creative Commons license has been embraced by the President-Elect means good things. Most importantly, that the President has knowledge of less-restrictive copyright methods, and first-hand experience that not only do they work, but that the sky doesn?t fall down when they are used, cannot hurt. That the license chosen was, in Lessig?s words, the ?freest license? is more encouraging still.

    One can only hope that when the likes of the RIAA and MPAA come to talk about further strengthening copyright, he turns around and says, ?I?ve been using these great CC licenses, have you heard of them?? Regardless, it?s a great boost to Creative Commons, as they prepare to celebrate their sixth birthday.

    This is actually bigger news than most realize. This coupled with his support of Net Neutrality means the internet stays free for a little longer.

                      It is designed from the ground up to be respectful of fair use rights.

                      understanding that means that you have to understand fair use.

                      by it very nature the seeder is committing no crime (he is never giving away a single copy of the file -- only non working copies) if you recognize the fair use right of using a torrent as most effective backup solution (for non confidential data) ever invented.

                                there is no way anyone can claim that creative common is a replacement for copyright nor have i ever made such a statement. The fact that fair use was defined in the original copyright act and defined as exemption from the normal exclusive rights granted by the act.

                                Creative common was created out of the intelectual papers which descibed and condemed the overstepping of current copyright laws to control content distribution. The squashing of fair use free expression (parody, commentary). It was an attempt to prove that copyright holders didn't need to dictetorially control content (stomping all over fair use) and could even extend those rights beyond those granted explictly by the law and still make money.

                                the point i am making is that obama seems to get it, which means he is going to be more fair use friendly. Right like access shifting (currently not yet established by case law) would be more likely to be respected by future laws.

                                i am not arguing with you about the fundamentals of the liciencing schema, i understand them quite well. I just know the history behind them, the principles they were founded on and the consequences of the government finally getting those principles.

                                Fair use has gotten a significant advocate.
