The obscenity law is very vague, but the penalties are severe. In an article by an attorney I recall him saying that the practical/ average sentence for a 1 count obscenity conviction is... 5 years!!!!! Smoke that in your pipe!

How can community standards even be applied to the internet?
The adult webmaster is in real jeopardy when 35 year old rules are mistakenly applied to new media.
How can a federal law make something that is undefined a crime? How can the legal standard of what constitutes a violation vary in every single town and city in the country? That is sheer madness!
My *opinion* is that the thing I will call the "internet community standard" is very high, and that anything goes, except child porn and non-consensual/ forced acts. But, that is just my opinion on how the world should work, and nothing more.
The bottom line is that virtually anybody in this business could be charged.
If you don't want that to happen, you need lots of well thought out defenses:
1. Think proactive, identify your weaknesses
2. Locate in a good jurisdiction (Los Angeles --not Polk County, FL)
3. Don't push the limits!! No scat, pee, fisting, animals, violence, etc..
4. Comply with all other laws so they can't add on Mann Act, RICO, etc.. Don't pay models to travel, avoid multiple bad acts, avoid conspiracies in all forms.
5. Have good lawyers on retainer
6. Include artistic elements to leverage Miller
7. Be 2257 compliant
8. Don't make enemies

The Florida panhandle, correctly labeled above as "Lower Alabama", is a classic example.

Cops went wild, media went wild, cops seized condos, camcorders, computers, tapes and even a jet if I recall correctly.
Months later the GGW lawyers finally got it in front of a real judge. The judge reviewed the actual law on the books and realized the cops had it all wrong.... Bare boobs on a model under age 18 IS NOT illegal under Florida law (or most other states) unless the girl is being fondled by another person, and its not illegal at all under Federal law.....

I don't know about this case, but I think we should all give the lawyers and others time to sort it out.

Obvious drug use and activity.
Now prosecutors have the groundwork (immunity testimony) for bigger and more profitable (seizure) investigations. They have first-hand, elaborated knowledge of crimes. Witnesses. How business is done.
THIS ALL CAME TO THEM, WALKED IN THE POLICE STATION DOOR.
This particular county is offended. Elected officials want to keep their jobs. Laws are on the books.Comment
