    Warez Scene Member Sentenced to 18 Months Jail

    A member of the pioneering warez group aPOCALYPSE pRODUCTION cREW (aPC) has been jailed for 18 months. Barry Gitarts, also known as ?Dextro?, was sentenced after he was convicted of Conspiracy to Commit Criminal Copyright Infringement. Thus far, there have been 15 convictions of aPC members.

    aPOCALYPSE pRODUCTION cREW (aPC), was thought to be first organized ?warez? group to coordinate the pre-release uploading of mp3s to the Internet. Founded in 1997 by members known as acid^rain and Viper, aPC?s forté was the pre-release of music CDs which they obtained from music industry insiders and magazine workers. The group was raided as part of Operation Fastlink.

    According to evidence presented at his May 2008 trial, Barry E. Gitarts, aka ?Dextro?, operated and financed a server based in Texas which was used by aPC to store thousands of music files, movies, software and games. The New York resident was convicted of Conspiracy to Commit Criminal Copyright Infringement.

    On Friday, Gitarts, aged 25, was sentenced in Alexandria federal court to 18 months in jail for his role in aPC.

    Another ex-member of aPC, Jacob Stahler, aka Lunatik, was on the witness list at the May trial, and there has been speculation that he testified against Gitarts. Stahler himself was also convicted of Conspiracy to Commit Copyright Infringement, but was later sentenced to just 2 years probation.

    So far there have been a total 15 criminal convictions of aPC members, including that of Mark Shumaker of Florida (aka ?MarkAlso?), a previous leader of the group who already admitted criminal copyright infringement back in 2003.

          fact: in New orleans often murderers are let go after 60 days, they even have local gangster rap songs about "60 day homicides"

          murderers get less time than warez guys LOL

            On street corners and in the grungy holding tanks at parish prison, they have another name for it: "701," shorthand for Article 701 of the Louisiana Code of Criminal Procedure. It states that no one can be held longer than 60 days on a felony arrest without an indictment.

            Sometimes a 701 release merely eliminates a bond posted by a suspect in order to remain at liberty pending a trial. But in other cases, the 701 springs a murder suspect from jail because prosecutors have failed to meet the 60-day deadline, and that's been happening with astonishing frequency -- a tenfold increase -- in the widely criticized New Orleans criminal justice system since Hurricane Katrina.

                                        Lol, that happens in every city, if the prosecutor fails to meet the burden of proof for an indictment in a set time period then they can't continue holding someone and you can't call him/her a murderer if they haven't been proven guilty yet. Now if you'd said their overloaded system is causing some suspected felons to be set free because they don't have the resources and time to prosecute then that might have been plausible.

                                            yes, but this is only for murders against people the city considers "low priority"... like gang violence, poor on poor, etc..

                                            let someone middle class or above get murdered and the DA will make sure they get everything filed on time...

                                            even though N.O. has a high murder rate right now, its almost all gang/drug related...

The reason, prosecutors noted for the record, was that they never received a police report within the 60-day period. That's the same reason the other seven murder cases from the same seven-month stretch in 2005 tanked.

The two men accused of trying to kill police officer Kevin Thomas in Algiers during a post-Katrina looting spree were released from jail after almost 10 months in jail. Prosecutors say they knew about the case all along but couldn't make a case given the deficiencies of the post-Katrina era

                                                the other big thing is witness intimidation, its a small place. You rat on someone here, your family get shot.

                                                Prosecutors and police blame a lack of witness cooperation for derailed murder cases, and Criminal District Court is littered with files that are dead on arrival when a witness backs out or disappears.
                                                you can try to take up for these criminals, but around here, you know these people are guilty, many have been arrested MULTIPLE times for MURDER dude.

                                                the police are still running cases out of TRAILERS, there isnt even a CRIME LAB in NOLA LOL

                                                The lack of a local crime lab is taking a toll on the system and the crime rate, he said.

                                                  I had a friend get shot in the chest by a shotgun walking to his car after work... robbed for less than a $20 - died on a sidwewalk of NOLA. Its not all drug related.

                                                  they never got the killer, and there was even a protest of people walking the streets - no suspect ever found.
