Apple actually pioneered this with Safari; they stole KHTML from KDE to make WebKit, with the promise it would be re-released to the KDE team. As long as it was in beta, and unstable, they did not, and were not required to make any commits.
Long story short: Apple helped make the browser pass the acid test, but the code was (then) so hacky that the KHTML team basically dumped it.
