I have personally seen a dude get knocked out in a fight at a bar... he was doing the snore and twitching even, he got back up and worked the other guy up some more til the cops showed up. so, yes it can happen.
He could have gotten on top of him and held him down. Fact is the guy was unconcious and no longer posed a threat. If those last kicks ended up killing him, he would be arrested for murder. You have a right to defend yourself against a threat to you. An unconcious man is no longer a threat to you.
