You could give it to them or you can hang onto it... Everyone in their dog is going to say their domain is trade marked...
It also depends on your state laws... if you are in a different state and its bi laws on business name usage allows for it I would speak to their offices first and see if they will back you... ( its their job. )

the name is trademarked. he has no right to it unless he purchased it prior to the trademark and prior art proofed. he didn't register it cuz it was a cool name. he has no right to the trademarked usage of their brand. sadly this is a no win, no negotiation situation he's in.
