    AVNONLINE: DOJ Will Continue Obscenity Prosecutions

    In testimony this morning before the Senate Judiciary Committee's hearing on Department of Justice (DOJ) Oversight, Attorney General Michael Mukasey said that his agency will continue conducting "targeted, efficient" prosecutions of adult material, citing the government's recent victory in the Max Hardcore case in Tampa, Fla. as justification for continuing its attempted porn purge.

          I guess EU credit card processors will start gaining more business now that they are forcing the business out of USA.
          If I am not mistaken both Oral and Anal is considered obscene in some states, can anyone confirm? Also there was at some point 1 state where it was illegal to have sex on sundays, would a website displaying live sex shows be obscene in that state?

Most of the red states vote Republican and are hurt more by their policies than blue states. People in this country vote based on the guy they want to have a beer with or what their favorite radio talk show host tells them to do. It's why we have such a poorly run government.

It has nothing to do with protecting children, society or anything else they spout about. It's about getting old ladies to vote them back into their cushy over paid, gift ridden jobs in a few months.

                                                                                              If they wanted to really make a difference to the porn that's so easily attainable they could do it for easier and cheaper than going after a couple of extreme porn guys.

                                                                                                  If you read the article it sounds like they will still only go after the most extreme of the stuff. The AG even said he doesn't want to do something too tame and lose which would legitimize that part of porn, he only wants to go after the extreme stuff. If he tries say, an interracial site, and loses it would make that "acceptable" and that is not what he wants.

                                                                                                  But in a few months we will have a new president and we have an above average shot of having a democrat who will probably be less enthusiastic about going after us.

A couple months back Obama was in my city to speak. 75,000 people show up to see him. A friend of mine that is a conservative shows me a picture that was in the newspaper from the event. It seems that the flags in the park he was speaking at were at half mast for a police office that had recently died. Whoever organized the event put the porta-poties right in the area with the flags. It is kind of in bad taste, but he is convinced it was done on purpose by Obama's people as a show of disrespect to the police. The reality is that it was probably done by the city and that spot was picked because it was centrally located.

                                                                                                          He will not vote for Obama because of that.

                                                                                                                                      My understanding from speaking to a number of attorneys and constitutional law scholars on this subject is that regardless of how a given state or municipality's obscenity laws are written, such laws will not survive court scrutiny if they are substantially more specific than the Miller test.

                                                                                                                                      The only sex acts that are patently illegal to depict are those involving minors (and that's handled under statutes relating to child pornography, not obscenity), and those that constitute a recording of truly non-consensual sexual activity (and such depictions are not "porn," they are documentation of criminal acts).

                                                                                                                                      There are quite a few states that still have anti-sodomy laws on their books, but such laws essentially have been rendered moot by the Supreme Court's ruling in Lawrence v. Texas.

                                                                                                                                      It's all well and good to have a law that says "no anal sex allowed," but actually enforcing such a law is a very different story, in light of the court's ruling in the Lawrence case. The same can be said for obscenity statutes that get more specific than the Miller test, as that test defines (vaguely, at best) the extent of the government's ability to restrict sexually explicit depictions, which are presumed to be protected by the First Amendment until "proven" obscene at trial.

                                                                                                                                              You're friend is a retard and unfortunately there are millions of retards like him that vote and that's why we get the kind of government we have. So while it may sound undemocratic I don't think the everyone SHOULD necessarily get to vote. If I keep up on things and pay attention to the issues why should the vote of some dipshit who enver pays attention and only knowledge of the candidates and the issues is stuff he heard from other reatrds, count the same as my vote. My vote is INFORMED and based at least on some kind of logic.

                                                                                                                                              I'm not a huge c-span freak but I probably watch it more in one month than the average voter does in 5 years.
