    Sorry if the actual law bothers you. If you felt that his actions were defamatory, you would contact the owners of GFY.com to have it removed. If it wasn't removed, you'd send a C & D.     However, even if you could sue SOS for the damages and GFY was not liable for their own site, you would need GFY to provide proof it was him that posted. This would require IP checks, etc. I would have your lawyer do that first before filing a suit as any court in the country is going to ask you to prove he posted it.

    You also have to prove that damages occured by the statements that were made. According to YOU, they didn't:

    However, maybe Canadian law is totally different. But unless your suit completely spits in the face of past legal precedent, you'll be laughed out of court (and most lawyer's offices).

                        i know SOS, why would he put up bullshit? its simple. he paid fora product turned out to be not in full. that wasn't clear on the funds. you kept the money instead of refunding him. and gave no content. if anything i'd be a judge would probably ask you questions instead of going after him once he hears the whole story.

                        All in all posting on a forum about this all the time is crying out for attention. Are you that depressed/ill that you have to keep this up?

                                                                                                And they all contacted the forum or blog and demanded it be removed first. The lawsuit only took place after the forum or blog did not remove the defamatory content in a swift manner.

                                                                                                In those cases they also proved who posted the defamatory content. You can't go in and say "well everyone on GFY knows SonofSam is So and So". You have to proof it through various means. Without that, all SOS would need to do is say "I didn't post it" and the case is done. Otherwise he could sue Bill Gates and say it was him posting under SonOfSam.

                                                                                                And the post claiming it didn't hurt business is actually pretty damning. He would have to state he lied in that post. It's like getting in a car accident and bragging to friends how great you feel, then going to court a month later saying how hurt you are.

                                                                                                Either way, I'm just saying he has a much better chance of going after GFY than he does SOS. The first thing a good defense lawyer will ask is why no steps were made to delete the defamatory comments if it was so bad for business.
