2257 and TPG's

if you live or host in the US and your thumbs are explicit, then you need 2257 info, if I understand it right

I live and host outside of the US, so I don't have to worry about it

the others that you refer to, are I suppose, breaking the law if they are US citizens

So pretty much if I am a US citizen, then legal TGP's are out of the question I take it?

If you are just linking to other people's galleries then you do not need the docs for the gallery itself. That includes your sponsor's hosted galleries.

How you link to them is what can put you in violation of 2257. So you need to go with the method you feel most safe using. That varies from webmaster to webmaster.

A few bring up the argument that cropped thumbs from sexual photos could cause a problem. I personally don't think so since the crop isn't sexual, but it's your choice.

2257 hasn't been enforced once in 10 years, so nobody really knows what the limits are.

You'll also want to read up on the FSC's fight against 2257. They have an injunction against it's enforcement for now, and some lawyers say that applies to the entire industry. I personally would not just assume that, since what you do in the past is enforceable (if it isn't already) once the injunction is lifted.

One would be smart to forget that they ever heard that statement. When some religious nut, Republican or do-gooder fruitcake has you in his cross hairs, you better be sure your shit dosent stink. And its not a good idea to do something in violation of a law you feel is unconsitutional prior to said law being declared as such unless the issue is plain as day (this one isnt) and/or you are willing and fully prepared to pay the price should the courts poo on you.

I don't live in the US but a couple of my free sites are hosted on US servers.
I have ID for all the content on my paysites but not for the stuff on the free sites as its usually just a thumb linked to a FHG.
I really cant see how the US government can do anything about this if they look the billing address up for the hosting they will see that I am not based in the US so all they can do is get the hosting company to pull my sites in which case I will just move it to another company.

They can't apply US law to people who don't live there, that would be likely arresting everyone from the Netherlands who legallly smoked pot under Dutch law as soon as they stepped on US soil just because cannabis is illegal in the US

This is what i think but i'm not sure... don't want to move my sites around and lose traffic.. :S
