It's that 2% that causes all the problems. Then there is another 10% that will get caught sooner or later.
The bottom line is to not let ANYONE, especially the Thais, know what you are up to. If nobody knows, they odds of you getting caught are between slim and none. Though I did read something about how Thailand is now scanning what is being downloaded and viewed online so use a VPN or something.
