What the FUCK is wrong with people?

Excuse me while I whine for a second.

I'm on my way to court for the THIRD motherfucking time to try and collect MY OWN fucking money.

A few months ago I sold my share of an offline "mainstream" business. Since practically day one the dipshit who purchased it has been a total fucking douche about making the payments. I took him to court immediately the first time and got it handled. The same pattern of late or no payments began almost immediately after.

The guy gave me EVERY excuse in the book, all of which were utter bullshit. I KNOW how much the goddamned business brings in. I ran it for 3 years.

So now his debt to me is AGAIN up to 5 figures and I'll go to court and the judge will prolly give the fucking cock ANOTHER god damned month or two to reconcile the debt, and thats if the dudes lawyer doesnt fucking get another delay.

It's starting to cause SERIOUS financial problems on my end, and HE just got back from vacation.

Maybe I should just burn the motherfucker down...

I hate people who can't seem to see that running a business in a small industry (that was games development) needs to be friendly, nice, and reliable. Maybe we're to soft! Ask the judge to consider rewarding you with the site being returned to your control until all monies are paid and see how fast the guy comes up with the money.

I feel your pain dude. Lately we're in a similiar situation with a client - he bounced a check with us and now he's ignoring phone calls and email.

I've got a call in to a local collection agency, but they take 35% for their service...so I'll only go with them as a last resort option. I'm also lookin' at the costs involved for small claims court and whether it'll be worth my while.

Fuckin' people and their worthless personal checks. Its maddening.

I won the judgement (obviously), so what do they do?

Schedule a fucking "damage hearing" 6 weeks down the road. In the meantime he won't pay at ALL, then even when they do set damages I'll have to fucking HOPE he pays.

Just fucking kill me.

Once you get a judgment against him, then file a request for a certificate of judgment lien with your common pleas court clerk. Then, begin collection action (through the court).
There are all sorts of fun ways to collect. Start with garnishing the bastard's wages, bank accounts, and go on from there.

In all seriousness...who sells their business and agrees to a payment plan to pay it off???? I sold a small business before and I got $75K for it (it was a pizza shop) and the money was paid to me all up front before we signed the paperwork.

If someone offers to make payments on your business that you're selling then that should send up every red flag known to man! Why would you put yourself in that situation? I mean what if he totally blows it and didn't do the same numbers that you did when you ran it? What if he just drives it into the ground and declares bankruptcy? Then you're ass out and having to deal with the shit you're dealing with now.

If you want to buy my business then get a loan from a bank that can pay me 100% of what I'm charging. Otherwise I'll find another buyer.

Sorry about your situation, bro but you really did put yourself in this bind. Good luck collecting the rest of the loot. Try putting every lien possible on the fucker (depends on the business type) but in some cases you can put liens on his private holdings like his house, cars, etc.

My favorite is till taps for retail businesses. They make a sheriff's deputy sit at the guy's place of business and take all the cash as it comes in. If he isnt incorporated, you can probably go after personal assets too.

It was a split. He got a loan to finance a portion of the sale, supposed to be making monthly payments on the remaining outstanding balance. He WAS my partner so I felt safe.

Well if he defaults on whatever order is issued by the judge during the damage hearing then I assume seizure and/or liens are the next step. Would still have to go to court AGAIN though.
