Affiliate conduct... should this be allowed?

I have an affiliate that has posted a couple of our ENTIRE video and photo sets in their members area. Not promo material, and not sample pics or videos, but a couple of our entire weekly updates.

This affiliate is padding their members area with other sites content. They are posting full length videos about twice a week, and there are clips from many sites... not just ours.

Is this standard practice for affiliates, or should I pissed?

he's padding his own members area with other people's content without asking - it's definitely against any program's rules to do that - i'd allow it if he was sending significant number of sales through that members area but i bet he doesn't.

I moved my sites to Vacares Hosting. I've saved money, my hair is thicker, lost some weight too! Thanks Sly!

I was gonna say the same thing. If the guy's sending a bunch of sales from a protected members area why complain? If he put up full picture sets and videos on a FREE site, I'd see that as a little different.

The ratios are great... but the traffic isn't.
He's only sent 67 hits since the beginning of the year, and we've converted 3 of them, so he's 1:22 right now. But, with that large of an update with our content, does the viewer really need to join our site?

This is why it is wrong. He is using your content to sell his members area and keep his members on his site by giving them updates to multiple other sites.

Basically this is theft and should be reported!

Well, if he kept ADDING stuff, I'd tell him to grab a brain. If he say, rotated one set of pictures and one video every so often, I'd probably let him. If he's advertising your stuff on his TOUR, I'd can him immediately. Members are crosssells are fine imo, but there does come a point of abuse.

1:22 is pretty darn good though. If it were me I might talk to them, lay down some ground rules and try it for a while.

I disagree. If the stuff was on his TOUR, he'd be using it to sell his members area...and I'd stop him immediately.

If he wasn't linking to the site who's content he's using, it would be theft. Obviously he's not trying to hide it.

Like I said, I'd rather the guy do this than take the videos and upload them to a tube site.

Okay, that's totally different than what I thought. If he's using it on his TOUR, that IS theft imo.

Again, if it were ME, I'd contact the guy and tell him unless he complies you're gonna can him and serve him a DMCA. Make him play by YOUR rules, which imho should be what I suggested. Rotated content and NOTHING on his tour...that DOES take away from your site.

disregard what "standard practice" is.

The best way to approach the situation is with an open dialogue , unless he is blatantly ripping you off.

I would let him know that what he is doing is not permitted by your terms and if he would like to continue to use your content for his members area he must sign a contract that he is agreeing to "different terms" that you both agree on beforehand.

I know that as a TGP owner that I would never even think about doing this. This is just WRONG in so many ways and they are hurting the whole biz by giving too much away. This person sounds like a tiny step above a tube site. After all why would anyone pay to join you site if they are going to get to see all of the updates for free ???

I just want to make it very clear to our affiliates etc that we do not permit this kind of behaviour. We are in the process of taking legal action against this individual and he has been notified.

We will also be in touch with CCBill to request his account (the one for his site) be closed due to multiple instances of copyright violation.

He joined our affiliate program, then joined our website through his affiliate link. Then, he entered our site and took the content without letting us know anything, posting it on his website. I guess he figures that if he makes one sale he gets back what he paid for a membership.
