    DO I need documents from the models for this type of site?

    Hey,
    Long time listener first time caller.

    I'm designing a website for a local adult massage parlor. There will be images of the girls on this site; nothing hardcore or anything that would constitute a 'porn site', but some nude nonetheless.

    3 Questions:

    1. I know for porn sites you need documents up the ying yang, but what about this type of website? How thorough do I need to be with documentation?

    2. Who is liable for the content? I have no attachment to the massage parlor itself, but the domain name and hosting for the website is registered in my name

    3. If documentation IS needed for these models, just as with a porn site, then how how can 'artistic nudes' or other mainstream artists/photographers websites get away without documentation?

    If you are the owner of the site , yes you need. As designer not, in case that the content is provided by the customer. Otherwise yes you need model's permission. But, are you the owner of the domain which someone else uses? Who is? Can you trust him? Cover your back. Sell it to the site's actuall owner. Contact your registar about this. Also try to resell the hosting space.
    I 'am also a photographer. We have the permission of models before we publish anything.

      if its a site and company based in canada you do not need this as 2257 rules do not apply to us canadians

        if in canada just get permission from the model in writing to post said photos and thats it.

            How can 2257 be enforced in Cananda? Thats a section of US Code. The last time I checked, The US FedGov does not have jursdiction in Canada. If the webmaster is based in Cananda and has no physical point of presence here in the states, I would say he is exempt from the requirements but one should consult a lawyer as this is not legal advice and is only my uninformed opinion.

            In general, you should always have doco when you use anyone's recognizeable face, in the nude or not. They can still come after you for making use of thier image without consent if you just grab and go. Get a contract signed that spells everything out.
