It would be naive to imagine that - if only to protect themselves - all the freemail people don't keep backups. And if you really want to make yourself look guilty of something, one of the best ways in these circumstances is to start deleting your mails.
If you have been spamming, as some are suggesting here, I hope you get buried. But if your hands are clean you will not suffer more than a minor inconvenience, so why do anything which will make yourself look as if you have something to hide?Comment

It doesn't add up because Hellbilly forgot to mention that at least one of the recipients of his spam thinks that the spam was generated from the affiliate program (becuase the promotion of the affiliate's site is what was contained in his spam).
So the recipient(s) are suing the Web Site. Now, the Web Site is claiming that the Affiliate (hellbilly) is the guilty party (not them). So, now they need to sort out who was breaking all of the civil and criminal laws, so they can fuck them up in court.
The plaintiffs are hoping to pin it on the Web Site because they will most likely have more money than hellbilly.
CAN-SPAM's Criminal Penalties
The FTC has trained more than 1,700 law enforcement agents in the U.S. and Canada to enforce the CAN-SPAM Act. The CAN-SPAM Act details severe penalties for anyone convicted of breaking its laws. Fines up to $3 million; fines may be higher if they are tied to actual damages incurred by recipients of fraudulent e-mail.

If you delete e-mail after you receive a subpoena that requires you to provide them to the court you will be far worse off. Remember Yahoo E-mail is also stored with Yahoo and also the recipients have copies. With a proper subpoena, Yahoo will provide all e-mail to requesting party. I'm also sure that anybody else who received your e-mail would also provide copies.
They will also discover that you deleted e-mail after you received the subpoena.
This will destroy your credibility and whatever defense you might have had. The judge will find you in contempt and punish you accordingly. Then he will find in favor of whoever opposes you in his court and then punish you even more. Then criminal charges will be filed against you and you will go through another legal trial and finally, you will be punished for your criminal behavior. I bet you will be fined severely and spend a bunch of time in jail when it is all said and done.

Its obviously safe to assume they have to have backup copies of everything for situations just like this.
Deleting e-mails under subpoena is not only illegal, but would mean you are in clear cut contempt of court for which the judge will normally issue a warrant for your arrest.
