    Anybody ever license music from somebody before?

    I want to try to license the music (not words) from an 80s song. Does anybody have experience with this kind of thing? The song was popular during the 80s and its on many compilation cds. Do I still have to try to go through the original record company? Any help is appreciated.

      The RIAA can't help you in this matter. What song is it, and who is the artist. Tell me that and I'll tell you who to contact.

        it's going to be WAY too expensive for a porn site - there are two entities to deal with - first is whoever owns the publishing rights to the actual song i.e. BMI/ASCAP - then you need to deal with who owns the recorded performance of that song you want to license.

        the worst that can happen is you get a C&D - but there is always the risk you could get sued - i've seen big programs use coprighted music on trailers and never heard of anybody actually getting sued

            If the song is copyrighted and belongs to a publisher then you need permission without exception... The C&D has teath and if cought again you will get sued.

            As advised, find the publisher. Usually this is found on the back of the CD or in the CD jacket. Once you know the publisher and society the publisher is registered with you can contact through the clearance department. The big part is the type of use you are looking for such as synch or mechanical. This will determine how much the license fee is going to be as well be determined how popular the track is. In most cases the clearance person will have a price to quote but again based on type of use you have in mind. They will then proceed to get clearance for you. Depends on the band if they would consider adult or not.. Also you must be registered with a society as well or all this is pointless. Internet streaming runs at about $0.02 per time listened to.

            Not to self promote but try out skinmuzik.com and search under rock or 80's you might find a cheaper solution. Good luck

                That's the publisher.

                I have to tell you, the chance of you being able to get this licensed for anything involving porn are pretty slim. You can take a chance and try to use it without licensing. You will probably get away with it since it's an older song and the EMI Music publishing forces aren't as vigilent about enforcing those copyrights online.
