However I am not one to jump into a suit. Rather just ask someone to please pay for the out of pocket expenses and make it right.

Good luck with that, I can count on one hand the number of times I have ever gotten a chain store to take responsibility for something without going to court. Companies these days dont understand polite requests or simple letters of complaint. The only they understand now are Cease & Desist letters and summons. Its all fun and games until somebody gets sued.
