I read this whole fucking thread and it is still missing so many facts, that one can not make judgement on who is guilty of wrongful doing.
So were these servers used for email spamming? If so, then that's against SplitInifinity TOS/AUP, unless SplitInfinity agreed to let Bdjuff email spam on them, in which case Bdjuff would have to sign a contract stating so, or else SplitInfinity's orignal TOS/AUP would still apply. I highly doubt SplitInfinity would create a contract that allows Bdjuff to spam, in which case, all they would have is a verbal agreement, which means nothing in the eyes of the law.
For Bdjuff to demand a full refund of his money when he was email spamming on the servers, even saying he will take SplitInfinity to court is just foolish. IMO, that's like someone who sells dope saying, "If you dont pay me for all the dope I sold you, I will call the cops." However, neither Bdjuff or SplitInfinity has come out and said these servers were used for email spamming.

Ps: Actually something like this happened to me once. A guy who was a (unofficial) reseller for a hosting company sold me some servers. I cancelled after a month, however, he still kept using it and after 3 months the hosting company wanted to charge me $3k (because he disappeared). I didnt pay for shit! They called me nonstop at wanted to send a collection agency. I dint wait fucking 6 months like you did though, i called my dads lawyer and got things sellted the same week. From past experience anyone coming aboard with 20 servers should be a semi red flag that they MAY be looking to spam =)) A bit of enquiry may have be in order prior to approving the account...With that said Bdjuff and his metro self has been hosting with us for a long time and we have honestly never received one spam complaint with regards to any of his accounts, great guy to work with actually. None the less the Split guys are good people I'm sure they will work this out professionally. Good luck to all involved....

Wow, quite a bit of drama here this morning. I read thru bdjuf's story and Chris' response and I have to say the fact that Chris won't negotiate over the phone is rather disconcerning but I suppose after dealing with bdjuf's partner its plausible. Either way, if you're both in vegas it should be worth exploring having a sit down with each other to work this out. Hopefully you both can get this resolved.

I work and have worked mostly in mainstream with many large companies companies, including contract work for companies like Microsoft. They are very tough to deal with and they demand that they get what they pay for regardless of the cost/work. Try spending a few bucks on Google Adwords and giving them a bad credit card. They'll shit down your throat till they get it.
I just can't find one example of a succesful company that will throw thousands of dollars around and not care. Regardless of if you are a millionaire or not, $8k buys a lot of shit and is not something to take lightly.Comment
