no comp clausules won't hold up in any dutch court....
I was just thinking the same actually. I know there is two sides of every story but from what I know and that is very little I would like to say that this didnt really make payserve look that good and didnt look like a smart move from their side.
I wish you the best of luck with your future Mike.

However, it has been my experience that many BIG companies, throughout the world, often use "tactics" that they know are not enforcable becuase they realize the former employee would have to spend a large sum of money hiring an attorney and fighting a long and expensive legal battle to ultimately gain nothing more then a "You were right" from the courts.
In my opinion, a former employee could easily spend $30,000 + for the court to say that the non compete agreement will remain in affect until the judge has made his ruling. You and I both know how slow court systems work and it wouldn't be unreasonable to wait upt to a year and a half before you heard that you were right all along.
So, basically after spending over 30K and not be able to work in the industry for a year and a half the only thing you win is a "you were right mr. Former employee "
In the end it doesnt make financial sense even though it does on principal.
I never post here since I couldn't care less. But I have known Mike since 2.5 years since he started with payserve and I would like to thank him for his help and advise. Mike helped me alot with promoting and I think he helped putting them back on the map.
Sexentertain_mike, I think you make a strong point here. Compete agreements can be hard to fight and the costs can become very high. If a company wants to fight it, for whatever reason, it can go through several courts and take up quite some time. Time means money with lawyers and spending a $250 bucks an hour is nothing special. If a company wants to fight through all courts I can imagine the costs would rise sky high and if you can't work untill the last word is said, you have high costs and you could extent the time you are not able to work.
First of all Mike is one of my favorite guys I met in this industry. Honest, smart, cool, nice and straight hahaha
Glad you are doing the best out of this situation! And as I know you, you will honor this "contract". (Other people do NOT honor contracts, all I have to say)
He was always there when I needed help or just someone to drink a beer and hunt women
I will look forward to welcome you back to the biz in one year! Can't wait! In the meantime let's stay in touch. I will try to come over there while here in Europe. Would love to check out that club with VIP treatment
This thread turned into a giant Mike love fest. I know Mike didn't have an ego before, but after 3 pages of hearing how great you are your head has to start to swell.
Anybody who has spoken to Mike for 5 mins knows that there is not one drop of malice in him. For anybody to insinuate that Mike did anything wrong in his dealing is crazy.
Mike, I'll miss you at the shows. When your ready let me know what your working on and we will find a way to do some biz together.
Mike thanks for the nice dinner yesterday and good to hear you are doing fine ! *thumbs up*
Merry christmass and a happy new year, see you in the new year dude!
