According to what I remember from my elective corporate law class (5 or so years ago), email, as with faxes and snail mail, serves as a legal means of notification, so yes - I imagine it is possible you could run into legal problems because of that.
I'd think, though, that if you reacted immediately upon being contacted by the plaintiff's lawyer on the matter and used the spam issue in apology, you'd still be a stand-up guy in just about any court in the U.S.
