No, most hosting companies shy away from it no matter if it is Legal or not.
If you can prove they opted into the email and are of age to receive adult mail and comply to the can spam act there should be no issues... Hosting companies want nothing to do with it and I dont blame them. Most people dont have the requirements and thats a lot of trust to put into someone when your business is riding on it.

bottom line: if the list is yours (the surfers entered their emails on your site), you shouldn't have much problem finding a place to host it. make sure you tell them you do double optin (although make sure you actually do) and honor removes daily. if spamhaus blacklists you, you should be able to get off the list if you can prove the people signed up via your site.
spamhaus should be shut down tho, they blacklist so many people needlessly, from real optin emails to compliant emails, something needs to be done about them.
anyways, if you bought this list from someone else and are sending unreleated offers, you better get some kind of direct solution with new ips daily.you don't know you're wearing a leash if you sit by the peg all day..Comment

I thought Can Spam set legal definitions to seperate fully legal mass emails from illegal mass emails (ie: spam). Such as forged headers, lack of physical address, lack of working opt-out, lack of adult label (if adult).
