just got another lame excuse from my iweb filipino being offline for few hours:
"my icq was disconnecting maybe everytime i connect it again. all of us have same problem evry 1 disconnecting I apologize for that maybe I ask to our systems administrator for that icq disconnection"

Well, you can never be so sure if he's working exclusive for you or multiple clients. Since there is no contract or whatsoever, I don't think you are bound by the Philippine labor law regarding 13th month pay. On outsourced employees, the company should handle that same with the other benefits stated in the Labor Code.
