If someone sits in a certain way, bends over, walks up a stair case, or whatever and stuff becomes visable to the eye in public it is fair game.
Now personally I do not care either way if the picture is posted. I just find the legal threats and such funny.

what we should do is setup an experiment
you go out in public and take some upskirts of girls..however you get them
then post them on your domains..and lets see what happens.
you can just tell them that you have a right to take pics and post whatever you want...make sure you tell the judge that as well.

Now, as for public picture taking. Keep in mind I'm not an attorney nor do I play one on GFY, but I know someone to whom this was relevant so did a little research. Please consult your own attorney.
The key phrase in these issues is "Expected right to privacy". If the woman in question is sitting in a bar unladylike with full bush exposed, you cannot publish those pictures UNLESS it's known to her. The same as if someone is jerking off in a mens room stall. Off limits.
But, if she's POSING that way, or lifting her skirt for all to see, it's fair game...even if she doesn't see everyone who's taking pictures. She has no "Expected right to privacy" in that situation. Which is quite different than someone kneeling down from 20 feet away and getting a good upskirt shot.
Now, THOSE pictures CAN be used in a members area, but they CANNOT be used to garner money from the public, ie-tour pages, UNLESS she's signed a model release.
So, when you see mardigras type sites, if they're following the letter of the law, my understanding is anyone on the tour is either a paid model or has at least signed a release. It's INSIDE the members area where you're likely to see your next door neighbor who flashed her boobies for all to see.

I can't believe we are even discussing this. People taking pictures at shows have a clear opportunity to ruin things for everyone.
I have been taking pictures at shows longer than a lot of people. I also have a large supply of camera equipment. I could easily get "unflattering" pictures if I wanted. I don't even post pictures of a girl if I think she wouldn't enjoy it (maybe she had food in her mouth, etc). It is called respect and class. And don't bring up Mediaguy, he made a post prior to Florida stating he enjoyed having pictures taken while intoxicated (his boss had the issue after the fact).
It is unfortunate, my girlfriend goes to shows with me and I have to pay attention and make sure no one does anything to harm her. That really is too bad.
