Can't say if they have "offices" in the US, but doubt it - that would be insane even with a contrived corp structure. Tho.. does not need offices to cause a problem - there are far too many US citizens as "names" in epass.
On the legal thing - if there is an interest - they are not in a hurry. It takes time to do the groundwork and build a case - and an chance of more rope being available during that time. Can think of one case - nothing whatsoever to do with ePass, which has been operational for about 3 years and still widening to encompass more "bodies" before a "hit" - so, basically time means little.
