a) saying he was "fleeing the scene" in your scenario assumes he wasn't fleeing with her still in the vehicle, leaving the husband with the reasonable assumption that he raped her and was then driving off with her
for those that can't read... they weren't in the house... they were fucking in his truck.
b) factoring "shot in the head" into the equation, assumes that it was intentional
c) Grand Jury made the decision.
d) if the prosecutor felt he could successfully prosecute the guy, he would. the guy was arrested for murder.
