just because you drink and drive doesn't mean its illegal... if you get completely smashed and go driving, yes it is, but you can drink so much and drive safely
only time i ever got pulled over after leaving a bar, i found out how much i could legally drink before driving

blew a 0.04, didn't get a DUI, but i did get arrested for no license or insurance :S
