New Orleans Mayor declares martial law in the city

7:32 P.M. - N.O. Mayor Ray Nagin declares Martial law in the city and directs the city's 1,500-person police force to do "whatever it takes" to gain back control of the city. He will also enlist the aid of troops.

As much as gangs roaming the streets and looting is a tragedy waiting to happen, they still have so many people homeless without food or water and slowly running out of hope. I'm sure more than a few that still need urgent medical assistance.

A military presence here and there, fine, but finding and moving people should still be the top priority right now.

Right dude. The safety of those who are still trapped inside their houses and needs evacuation must be their primary goal there.

Martial law was declared a couple of days ago.

Though many media outlets ? starting with local New Orleans TV stations ? yesterday reported that "martial law" had been declared in New Orleans, the Louisiana attorney general has confirmed that is not the case, saying no such term exists in state law.

Even so, Friday, three days before hurricane Katrina pounded the Gulf Coast, Gov. Kathleen Blanco declared a state of emergency, which gives authorities widespread latitude to suspend civil liberties as they try to restore order and bring victims to safety. While not technically "martial law," the emergency designation gives some of the same powers to government officials.

Under the Louisiana Homeland Security and Emergency Assistance and Disaster Act of 1993, the governor and, in some cases, chief parish officials, have the right to commandeer or utilize any private property if necessary to cope with the emergency, explained the New Orleans Times-Picayune.

Media organization apparently confused action taken under the emergency declaration or the curfew that had been declared with an actual "martial law" declaration.

I think it was the NOLa mayor that first used the term.

If its not on state books, could it not be declared by the federal govt.?

I agree but be realistic: New Orleans is under a lot of water, parts are inaccessible. There are thousands of people that need to be rescued. How would you like to spend 5 days on your roof in sweltering heat, no water, sanitation, etc. only to find out that you weren't rescued because the cops and army boys were too busy catching punks looting Sport Chek?
