Allowing stupid patents for simple concepts that have been around and used by numerous people isn't good for anyone.
Creative is going the route of trying to bring Apple down in stupid trademarks rather than make a better product. Maybe other gadgets are great for the tech geeks out there, but hands down the iPod just utterly dominates everything for the other 90% of the population (that doesn't give a shit about things like OGG and other geek magnets)
I don't see any chance that Apple would ever pay them a dime on that patent.
If this is truly the basis for the patent: "It applies to the way music tracks are organised and navigated on a player through a hierarchy using three or more successive screens," then I don't see any chance in hell they will beat Apple.
I agree with Kanon, they should try to make a better product if they want to beat Apple.
