Then after that time has elapsed, one party needs to be served if it goes that far, then after another period of time pending no other legal action has taken place a sheriff can then come and lock out the party. The house owner still of course would need to properly store and inventory each and every item for a reasonable period of time which most courts agree is between sixty and ninety days. Otherwise one could really be looking at loosing quit a bit in small claims court or civil court depending on the value of property and such.

There are of course other legal tactics that can speed it along or mess with the other party, such as avoiding being served or filing a restraining order.
