Now taken by itself as a sound byte like in the first post, it spins pretty scary. Most seem to be thinking that those things have to be given to someone. WRONG, lol. Read the whole thing for an actual understanding.

PR, I'm not bashing your company.. But the fact stands, I'm not making this shit up. Everyone can read it.. The companies listed have to keep records and turn them over on request, at any time.. That is different than just "keeping" records. Some listed companies have to turn over all webmaster recods, mailers or not. If you didn't do anything wrong then you shouldn't have settled.

Me making a post that we have webmasters that mailed us, and people really mailing us is totally different. I have had CEcash mail us on double opt in, but not EGC.. That was during the time I worked for LargeCash.

I do think if you didn't do anything wrong, or if you did run your business legit, then you should have fought it. If you did settle it means you did some shady shit. And I can bitch about that.. I run a clean business, no bs, no spam, fraud, complaints, or other crap. Being so, that gives me the right to bitch

Well - here's hoping none of the mentioned programs really did give a list of their affiliates (and dont plan to) since it looks like they all have a privacy section of their affiliate TOS that legally binds them. It wouldnt take much for a lawyer to have a field day if they ever did send a list to anyone with any personal info on any of their affiliates without permission first.
And most importantly, hat they let the government know about those privacy sections of their TOS since the government is required to follow those as well if that was a preexisting agreement.
That said - I dont truly believe that any of these affiliate programs lawyers would allow them to give out the names or any other private info without prior knowledge of the affiliate as even the lawyer would then be liable.Comment

By Settling with the FTC, A company can dictate specific terms, convince the FTC to change, or lessen the impact of other terms, and get penalties reduced. Right on the every release from the FTC it clearly states that none of the settlements are admittance of any wrong doings on the companies behalf! So you pay a fine and get back to work.
Fight the FTC, and you will be tied up for a very long time. If you are smart you will get a Lawyer specializing in FTC litigation, and you will pay several hundred thusand in legal fees. In the end, at best, you will only loose a years worth of progress, and the several hundred grand in legal fees. at worst, you will loose a years worth of progress, the several hundred grand in legal fees, the maximum fine that the FTC can impose $11,000 for each and every spam complaint they have ever received on your behalf. and you will be forced into an order with much stricter guidelines on what information must be maintained, and you will definately be forced to give that information up!
so, these companies settled, they are back at work, they paid there fine, they are keeping the proper records, (which are records that every single company that isn't run out of a bedroom should keep anyways) Meanwhile, the companies that are fighting the FTC have literally no chance of winning, and when the case is over, their doors will shut,, adn every piece of information they have on every affiliate they ever had will immediately be handed over to the FTC

While nothing is wrong with making a settlement the companies in question could modify the agreements, which some did. I wouldn't have agreed to some of those terms. Someone could mail you now, without you knowing and it's your ass. That is just wrong.. And some of the companies that are fighting do have a chance. Not everyone "allowed" non-compliant emails, not everyone paid the webmasters that sent non-compliant emails. And... Not everyone is fighting; some are working on better deals so they can't get fucked over in the end.
BTW, I would recommend you look at the spam law and find out how much it says the fine is for each email spam. You may start to see how they used wording against you.
I know little about legal fights; we have been fighting GST in Canada for 2 years now. The only adult company to do so while everyone else settled. It's worth the fight, the time, the energy, and the money. When things aren't right you fight.Last edited by TheDoc; 07-29-2005, 01:02 PM.

Just to help you guys understand how the FTC works, well how FTC lawyers work. They lied to you, which is illegal btw... No fine of $11,000 per email, it's a way to scare you into settlement under the agreement set by them. I heard what went down btw.. I didn't post this to get webmaster sales, jackass. I posted it to point out facts, which I did. You tried to turn the tables towards me but you can't. Fact is you sold out your mailers, even if you didn't sellout your webmasters. Of course you don't allow mail, your agreement doesn't allow you to mail anymore and you have been doing this since, what Jan of this year? 6 months ago? Of course you haven't allowed mail for 6 months.
As for my program, I don't pay per signup, I'm recurring, I don?t need to be pps. I have about 2000 webmasters, about 30% active. This program is a little more than a year old. I send a large amount of in-house sales to myself. I also own a content plugin, 3 years, running strong, and still growing, still in demand, with new plugins on the way.
I'm not a little fish as you may think.. I have been doing this business for 9 years. I have owned some of the largest sites and sold sites, programs, etc. I'm not a monster company either.. My knowledge of this business is well above yours, so please.. Don't even try, your wasting my time and energy and yours..
Back the post subject. You can say what you will, you broke the law, you had to cover your own ass by paying a fine, you got scammed into the deal by the FTC, and you sold out your mailers and now your books.. Now you come here and try to turn the attention away from you, which I won?t allow. You want to push my buttons I will keep this post going, and focus on you.
