The joke is that this case has little to do with Germany - the issue is being presented to German prosecutors in the hope they will accept it since German law permits prosecution of serious offenses irrespective of the jurisdiction of the alleged crime.
The case is being presented by a team of US lawyers seeking remedy on behalf of 12 individuals who claim abuse and torture.
Obviously it is miles away from an actual prosecution, but could be an introduction to the ICC, depending if the case is strong enough - that remains to be seen.
