The case is being raised by the US-based Centre for Constitutional Rights and representing a Saudi detained in Cuba and 11 Iraqis held in Baghdad.
The only reason it's being presented in a German court is that their laws allow the pursuit of cases originating anywhere in the world. This is not the first attempt by the Centre for Constitutional Rights - a previous try was made in 2004, but German prosecutors dropped that case.
