Yes, I'm one of the Plaintiffs (and, I won't be surprised if the IRS/DOJ/Etc hassles me for agreeing to be part of this--actually, I'm honored to be asked to be a Plaintiff, and agreeing to be part of it was the the right thing to do.

Hey Dave. Glad to see that you are involved with the action to take on the DOJ.

I've heard Dave speak on several occasions, most recently at the Exotic Erotic Ball last year in the Bay Area, and I can tell you that he is as good of a spokesperson for talent in the industry as there could be.

Dave also has a wonderful sense of humor - I hope he won't take it the wrong way, but given that he is an elder statesman of sorts (writing for AVN, etc), I consider him to be the Wavy Gravy of the adult biz...loved by all.

Good luck fighting the good fight, Dave.

Eek... I wonder how it'll all turn out I feel sorry for the adult industry so far, but am also curiouis why some of the bigger web names haven't stepped up to bat... Instead they just shut their affiliate programs down, or radically modify them..

I appreciate the kind comments, but my intent is to provide you with important update info (not to garner pats on the back for me!).

We Plaintiffs and a bevy of top attorneys go to Denver on Wed for a Court hearing on Thursday concerning the TRO. It's crucial that we get the TRO, and the follow-on Injunction we'll later be seeking.

I will do my very best to well represent the Adult Internet and your interests, as well as the Adult Film folks! We're all in this together!

whoa. don't the new regulations go into effect that day (thursday)? will it be decided that day or can the regulations go into effect while the court is still deciding on whether to grant the TRO?

Plaintiff is the person bringing the lawsuit.

In this case, the Free Speech Coalition is petitioning the court for a temporary restraining order to halt the enforcement of the new 2257 rules while the court is hearing their case challenging the constitutionality of the new laws.

The defendent is Gonzalez, the Attorney General (head of the Department of Justice).

Where in the article did you read that the hearing is on the 23rd ?

In the 8th paragraph down, the aritcle says " A hearing on the TRO has not been scheduled at press time, but is likely to occur early next week. "

Since the article was published on Friday, I would assume that means early this week.

It's been posted elsewhere. Even the time of the hearing.

The standard for approving a TRO is quite low compared to proving the case - essentially it is like a pre-trial hearing where the only thing you need to show is that you have a case worthy of being heard before a trial judge.

In this particular case, that standard should be easily met.

I would expect a decision the same day, or shortly thereafter.

Get your paperwork in order, and stay tuned...

If you haven't already kicked over some $$$ to the FSC, this might be a good time, since they are waging your battle.
