    Hi!

    We are currently in the process of adding all model releases to the ZIP files that we deliver to our customers, the model IDs were already part of them since day one we started our shop. And I am happy to announce that besides some very old sets everything is absolutely compliant with the new regulations. So whoever bought from us and is in need of the model releases should simply hit me up - it's just a matter of minutes. And if someone bought one of those old sets (about 20 of nearly 400 items) I would certainly replace them with a compliant one free of charge.

    So far our license allowed to give up to 30 pics of each set to affiliates or to use them for FHGs.
    Now that IDs should be given to affiliates we are of course concerned about the privacy of our girls - and we are discussing the best solution for everyone involved.

    Solution 1:
    Content can be given to affiliates, incl. IDs => potential danger for the girls who might quit working. that would be a danger for our business in general - no models = no work

    Solution 2:
    Content cannot be given to affiliates at all => less customers might buy from us and potential stalkers can still buy a set to get the IDs

    Solution 3 (my favourite one ):
    Up to 30 pics of a set can be used for affiliates or FHGs - but just non-explicit ones that do not require IDs. Since we do mostly just solo girls, there are always enough pics for that in every set

        Solution 3, IMO it's not an option to give out model ID's to affiliates at all... in your case (you're German right?) it's even against the European privacy laws

          models sign modelreleases where they give their ok to give away their ids for those purposes. but i don't feel that this gives me the right to actually do that - morally. at least not in any case.

            I'm pretty sure European laws contradict that this is legal, however it's not my specialization so you could very well be right. I do agree however that it would be morally long, plus in the end it would hurt your business because of a lot of models getting out of the business because of this.

                I think the best option lies between two of the options you have given. All profit aside (since thats what this thread is about), I think that if you're trying to do the right thing you should present the models two options - 1) Allow their IDs to be given out, and pay them more for it (since that set can now be sold to more people) or 2) their IDs will stay with your company only, and you are legally prohibited from giving them out. Either way, the model should be informed of the benefits of doing either, in clear language, not legalese.

                IMO, thats the morally right thing to do

                        That's not straight from the regs....it's straight from the DOJ's response to comments on the regs.
                        That's their interpretation of what the regs mean, not necessarily the conclusion the court will come to.

                        The DOJ also seems the think that since the DC district court didn't specifically say there was something wrong with the secondary producer provisions of the regs in 1994 that they're ok too. (Even though that issue was never argued before the DC court)

                        They also go even further and dismiss the Sundance ruling which was made a year after the DC court ruling, AND in which the secondary producer provisions were specifically addressed.

                        It takes some serious mental gymnastics to come to the conclusions the DOJ has made.

                            The primary producer of the content is giving the documents to the secondary, it's just not allowed to give it to the third person.

                            You can still give out the soft content or give it to Non US affilaites. The license was there, the license was sold, the license still works. No refunds.

                            Also if all the sales were refunded we would be out of a job, you would be out of content and also out of a job. Traffic would soon dry up if it were jsut left with the few who will stab their models in the back.

                            Good move MaDalton, ensuring models still work for the Internet is our primary concern.

                              it's not regarding content that is already sold, i'm having a new license and i need some input how to handle this issue in the future.
