        Why wouldnt they? All policies are required to provided minimal liability coverage, and PD liability is exactly for this type of situation. Unless he was in the process of committing a felony (a common exclusion in most insurance contracts) they should have to pay out. Of course, as you pointed out, this assumes he has insurance.
