POSTED: 6:44 am CDT June 7, 2005

LUFKIN, Texas -- A 19-year-old East Texas man faces a life prison sentence for causing his teenage girlfriend to miscarry twins, even though she wanted to end the pregnancy.

Gerardo Flores was accused of causing the miscarriage by stepping on his girlfriend's stomach. He was prosecuted under the state's new fetal protection law.

Erica Basoria acknowledged asking Flores to help end her pregnancy. But the 17-year-old can't be prosecuted because of her legal right to abortion.

The defense contended that Basoria punched herself while Flores was stepping on her, making it impossible to tell who killed the twins.

The jury reached a verdict after deliberating four hours. Because prosecutors declined to seek the death penalty in the case, Flores received the automatic life sentence.

i mean he is only 19 and they were both probably scared as fuck, so if they walk to the abortion clinic and get it done there is a "difference".

Same as with euthanasia.. just cos someone is asking you to help them die, doesn't mean that you have ANY right to do so in the eyes of the law.

People get scared, they find themselves in a corner and so they do what they think is best to get themselves out. Sometimes it works, and sometimes it's a tragedy like this where some poor teen gets the rest of his life screwed cos he got his girlfriend pregnant and then tried to help her get rid of the 'problem' (albeit in a strange manner.. standing on her stomach while she hit it was definitely not the smartest way to go about it).

Sometimes life just isn't fair.

at 19, if he doesn't know any better than this, he is not going to start making good decisions in the future.

As far as the abortion clinic, I dont think thats right either. My mind really got made up recently on the abortion issue when I could talk to my wifes stomach and feel my son responding to my voice.

People will argue and the supreme court has trouble deciding the issue, but for me, I'm pretty much decided that once that baby starts growing, the mom, (and the dad for this case) lose the reproductive decision making "rights".

Two things mentioned on gfy today. One dude got caught molesting a four month old, the old got caught murdering a younger baby.

i am 100% pro choice, how on earth can you not belive in abortion? i commend you for going through with having a child but some people just are not ready to have kids, mistakes DO happen.

now i am not taking any sevarity away from this case it is indeed terrible.

but for a life sentence realise what that means it means LIFE! as in LIFE! this kid is 19 and could have just walked to an abortion clinic and gotten off, he should know better, but remember this is LIFE in prison imagine being in jail for life because of a mistake you made when you were 19.

These type of " crimes " will be on the rise after the bunch of laws on abortion, including the one where the doctor MUST advise the parents of the girl ...
On the other hand, preaching abstinence instead of use of condoms is definitively going to reduce the number of unwanted pregnancies ....

It obviously was planned by both of them, although it's horrible to think about, they did it stupidly, and likely didn't want anyone to know she was pregnant so they did an abortion themselves ... with a stupid way mind you, but it was free, and no one would know.
