machinegunkelly, as far as I can tell from reading all this, what you are doing is charging him what is essentially a fee(you took his money and didn't deliver the designs-albeit a little later on) for making you wait a couple months to continue the work.

He paid you $7000 up front, entrusting you to deliver the designs. I can't see any real valid reason why you are not finishing them, all on account of them not being organized with their content at the onset.

If Quashe had this little patience with us... oh dear

The guy leave for 2-3 months, come back and expect you to pick it up as you were . Sorry but when I design something, if I restart working on it months later, it's gonna take me twice the time cauz I'm not in the same mood and my style change . If it's a bulk deal, you don't spread it over 3-4 months .

Okay , Maybe in my anger over the situation I haven't been clear .
I have been patient with Mark since day one .

When we agreed on this I told him to have content and payment ready for the start date .

Yes he had some content ready .. but how do I build a site with no content people ?

When mark approched me just before Xmas , I told him he was going to have to wait till after Xmas .. you can see above I said getting anything before newyears wasn't going to happen .

So then this month ( a year later ) he approched me with the toons idea , not mine .. his " Do 2 toons and we'll just forget about it all "
Which I did FAST .. not only fast but I dropped other projects to get it dealt with ASAP so I could say good bye to mark .

Well point is I designed 10 sites .
Those you see there plus 2 more I think and the beginning of Digibucks which he said he would pay for .

Mark wanted to watch my progress on all sites and had me do one at a time and approved each of them before I moved on to the next .

I'm sure if you went to Quashe , had him design 10 sites with not enough content and then went back a year later expecting him to do 10 MORE sites cause you couldn't get your shit together the first time , he'd be pretty upset too .

Mark aint no nOOb , he knows how to swing this .
The minute I posted this he sent a mass message to his ICQ asking everyone to back his ass up .

He can try and swing this his way , but the fact remains that he hasn't followed through with his end of the bargain at any rate .

Payment was supposed to be upfront .
He sent $5K and then made me wait until I was threatening to rerate his project before finally sending me the rest ,

Content was supposed to be ready for the sites :
Lee or whoever couldnt sort out the content and never got it at all .. then the project is put on hold after I not only worked on it for month straight but ALSO lost the potential revenue I could've booked in this time frame .

So time goes on and mark approches me to do his toons :
2 toons to let the " debt " go .. I do them ( see theres me doing my part of the deal again ) remember folks .. this is his idea not mine .

Then mark orders one toon ( 2 character ) and agrees to PAY FOR IT ( now , if I owed ya money .. why ORDER stuff ? hmmmmmmmmmmm

So I do the toon ( yep .. theres me keeping up my end of the bargain again )
I contact mark for payment and get told to take it to GFY .. here we are .

Mark knew he could swing this in his favour .. not hard when you have a program etc to back you up .

But the facts are clearly as I have stated .

I am a father who tries to put food on the table for my children and I have been screwed for over $1500 just in may .

Anyways . I'm not saying machine gun kelly shouldn't have given him his full paysites. I'm saying that he agreed to something, and backed off and used the content . That's what is wrong .

correct me if im wrong but,

Digibucks agreed to clear any past due monies (the 10 sites for $7k deal) if Kelly made him 2 toons. Digibucks then offered to pay an ADDITIONAL $125 for a third toon, Kelly agreed and delivered the 3 toons.

Now Digibucks doesn't want to pay Kelly the $125 for the third toon since he feels he already made out on the previous deal. Problem is if he felt that way he shouldn't have offered the ADDITIONAL $125.

Even though Kelly got the better end of the $7k, Digibucks made the terms so why shouldnt he have to honor them?

2)You designed me three toons $375 value to clear this debt! You gained out of this

Lets get some facts staright here according to what has been posted.

1. Digi hired kelly to do bulk work. Got bulk discount on said work.

2. Kelly gave digi a start date and informed him to have all content ready to go.

3. digi did not have all content ready to go.

4. Kelly has 10 psd files ready and waiting to be finished with the content digi never produced.

5. digi went to kelly to clear the deal up. both agreed, deal is finished and done.

6. digi order another design and when payment time came digi said fuck off because of previous deal which was supposed to be squashed and closed and done.
